AMP RESPALDA ANTEPROYECTO LEGISLATIVO QUE BENEFICIARÁ A LA GENTE DE MAR
La directora de la Dirección General de la Gente de Mar (DGGM), de la Autoridad Marítima de Panamá (AMP), Maryluz Castillo y la Honorable Diputada de la Asamblea Nacional, Lilia Batista se reunieron para impulsar la nueva Ley que reglamenta el trabajo en el mar y las vías navegables.
También participaron de la convocatoria el sub-director de Dirección General de Gente de Mar (DGGM), Felipe Arias, la jefa del Departamento de Asuntos Laborales Marítimos, Mayte Burgos y la asesora legal de la DGGM, Debbie Moreno.
El encuentro se centró en el Anteproyecto de Ley No. 189, que dicta el marco regulatorio del trabajo en el mar a bordo de naves mercantes de servicio interior en la República de Panamá y de naves de pesca comercial de servicio interior e internacional de bandera panameña, y se dictan otras disposiciones.
El objetivo de este Anteproyecto es modernizar el Decreto Ley No. 8 de 26 de febrero de 1998, legislación que ha estado vigente durante más de 25 años y que requiere una nueva norma, actualizada y acorde a los avances del sector laboral marítimo, para garantizar los derechos de la gente de mar.
La directora Castillo indicó que la AMP contrajo un compromiso con los sectores marítimo, portuario y logístico, por lo que la modernización de esta legislación traerá consigo un impulso en la generación de empleos, promoverá la inversión, y establecerá un marco regulatorio moderno y flexible.
La diputada Batista valoró positivamente la convocatoria, resaltando el fructífero diálogo que se estableció entre empleadores, trabajadores y gobierno nacional. Gracias a las más de 105 sesiones de la Mesa Tripartita de Mar (METRIMAR), llevadas a cabo entre julio de 2021 y enero de 2023, se logró un consenso y se elaboró el documento base del Anteproyecto de Ley.
La representación del Gobierno en METRIMAR recayó sobre la AMP, el Ministerio de Trabajo y Desarrollo Laboral (MITRADEL) y la Autoridad de los Recursos Acuáticos de Panamá (ARAP). Los trabajadores estuvieron representados por el Consejo Nacional de Trabajadores Organizados (CONATO) y la Confederación Nacional de Unidad Sindical Independiente (CONUSI).
En nombre del sector empleador participaron el Consejo Nacional de la Empresa Privada (CONEP) a través de la Cámara Marítima de Panamá (CMP) y la Cámara Nacional de Pesca y Acuicultura de Panamá (CNPA).
La Escuela Interamericana de Diálogo Social, Tripartismo y Resolución de Conflictos (EI-DISTREC) de la Universidad de Panamá (UP) actuó como moderadora de las mesas de trabajo y junto con la DGGM, se encargó de revisar todo el material consensuado para unificarlo y aportar al país una ley adecuada al ritmo imparable de los procesos de evolución social.
PMA SUPPORTS LEGISLATIVE BILL THAT WILL BENEFIT SEAFARERS
The Director of the General Directorate of Seafarers (DGGM) of the Panama Maritime Authority (PMA), Maryluz Castillo, and the Honorable Senator of the National Assembly, Lilia Batista, met to promote a new law regulating work at sea and on waterways.
Also attending the meeting were DGGM Deputy Director Felipe Arias, Head of the Maritime Labor Affairs Department, Mayte Burgos, and DGGM Legal Advisor, Debbie Moreno.
The meeting focused on Bill No. 189, which establishes the regulatory framework for work at sea aboard merchant vessels serving domestic routes in the Republic of Panama and commercial fishing vessels serving both domestic and international routes under the Panamanian flag, along with other provisions.
The objective of this Bill is to modernize Decree Law No. 8 of February 26, 1998, legislation that has been in force for more than 25 years and now requires an updated regulation in line with the advances in the maritime labor sector to guarantee the rights of seafarers.
Director Castillo stated that the PMA has made a commitment to the maritime, port, and logistics sectors, and that the modernization of this legislation will boost job creation, promote investment, and establish a modern and flexible regulatory framework.
Senator Batista praised the meeting, highlighting the productive dialogue between employers, workers, and the national government. Thanks to more than 105 sessions of the Tripartite Maritime Table (METRIMAR), held between July 2021 and January 2023, consensus was reached, and the draft of the Bill was developed.
The government’s representation in METRIMAR was carried by the AMP, the Ministry of Labor and Workforce Development (MITRADEL), and the Panama Aquatic Resources Authority (ARAP). Workers were represented by the National Council of Organized Workers (CONATO) and the National Confederation of Independent Union Unity (CONUSI).
On behalf of the employer sector, the National Council of Private Enterprise (CONEP) participated through the Panama Maritime Chamber (CMP) and the National Chamber of Fisheries and Aquaculture of Panama (CNPA).
The Inter-American School of Social Dialogue, Tripartism, and Conflict Resolution (EI-DISTREC) of the University of Panama (UP) acted as the moderator of the working tables and, together with DGGM, was responsible for reviewing all the agreed-upon material to unify it and provide the country with a law that aligns with the unstoppable pace of social evolution.
