Los nuevos directivos de la Autoridad Marítima de Panamá (AMP) y la Asociación Panameña de Derecho Marítimo (APADEMAR) sostuvieron una reunión de acercamiento para desarrollar estrategias que permitan mejorar la imagen del Registro de Buques de Panamá.
El encuentro liderado por el subadministrador de la AMP, Alexander De Gracia se concentró en los aspectos que el país requiere enfrentar de cara a los desafíos de la industria marítima.
Entre los temas concretos planteados por APADEMAR en este encuentro están: el mejoramiento de la competitividad de la marina mercante, la reforma a la Ley General de Marina Mercante (Ley No.57 de 6 de agosto de 2008), el proyecto de ley sobre sociedades marítimas y el fortalecimiento de los consulados.
De Gracia subrayó que esta entidad mantendrá una política de puertas abiertas con todas las organizaciones del sector para alcanzar objetivos comunes. “Estamos comprometidos con la mejora continua de nuestros servicios”, destacó el subadministrador de la AMP.
En cuanto a la flota panameña, afirmó que el objetivo de la administración es crecer en calidad. “En el corto plazo, lanzaremos el proyecto Segumar 24 horas Panamá, lo cual nos permitirá ofrecer un servicio más eficiente” anunció el subadministrador.
De Gracia anunció que se tiene definida una estrategia para cumplir con el Memorando de Entendimiento de París (Paris MOU). Sin embargo, reconoció que alcanzar los resultados deseados requiere tiempo y un riguroso seguimiento de estadísticas e inspecciones.
La AMP está en un proceso de reforzar las inspecciones en los buques. Este tipo de acciones reducirán el número de detenciones de naves y optimizarán el desempeño del registro.
Por su parte, el director general de Marina Mercante, Ramón Franco resaltó que esta administración priorizará el ingreso de naves de nueva construcción y la implementación de estrictos protocolos de debida diligencia. “Esta estrategia permitirá mantener nuestra posición entre los registros más importantes del mundo”.
Franco resaltó que para alcanzar este objetivo es fundamental trabajar de la mano con el gremio.
Los representantes de APADEMAR también resaltaron la importancia de que Panamá firme el Convenio de Beijing de la Comisión de las Naciones Unidas para el Derecho Mercantil Internacional (CNUDMI), el cual versa sobre la venta judicial de buques.
Dicho convenio establece que una venta judicial realizada en uno de sus Estado parte que otorgue un título de propiedad limpio al comprador tiene el mismo efecto en el resto de los Estados signatarios, con lo que se reviste de mayor seguridad jurídica a este tipo de operaciones.
Para facilitar el funcionamiento de este régimen y la salvaguarda de los derechos de las partes que tengan intereses en el buque, deben expedirse una notificación y un certificado de venta judicial en el Estado en el que tenga lugar el negocio.
Los miembros de APADEMAR solicitaron la colaboración de la AMP para gestionar la suscripción de este convenio con el Ministerio de Relaciones Exteriores, lo cual optimizará el Registro de Buques del Panamá.
El presidente de la junta directiva de APADEMAR, Joaquín De Obarrio ratificó el compromiso de colaborar con la AMP en la consecución de los objetivos propuestos.
The new administrative team of the Panama Maritime Authority (PMA) and the Panamanian Maritime Law Association (APADEMAR) held a meeting to develop strategies aimed at improving the image of Panama’s Ship Registry.
The meeting, led by AMP’s Deputy Administrator Alexander De Gracia, focused on the challenges the country needs to address to strengthen its maritime industry.
Among the specific topics raised by APADEMAR were: improving the competitiveness of the merchant marine, reforming the General Merchant Marine Law (Law No. 57 of August 6, 2008), the maritime companies bill, and strengthening consulates.
De Gracia emphasized that PMA will maintain an open-door policy with all organizations in the sector to achieve common goals. “We are committed to the continuous improvement of our services,” highlighted PMA’s Deputy Administrator.
Regarding the Panamanian fleet, he stated that the administration’s goal is to improve quality. “In the short term, we will launch the Segumar 24-hour Panama project, which will allow us to offer a more efficient service,” announced the Deputy Administrator.
De Gracia also revealed that a strategy has been defined to comply with the Paris Memorandum of Understanding (Paris MOU). However, he acknowledged that achieving the desired results requires time and careful monitoring of statistics and inspections.
The PMA is in the process of strengthening ship inspections. These actions will reduce the number of vessel detentions and improve the performance of the registry.
Meanwhile, the Director-General of the Merchant Marine, Ramón Franco, emphasized that this administration will prioritize the registration of newly built vessels and the implementation of strict due diligence protocols. “This strategy will help maintain our position among the world’s most important registries.”
Franco also stressed that achieving this goal will require close collaboration with the industry.
APADEMAR representatives also highlighted the importance of Panama signing the Beijing Convention of the United Nations Commission on International Trade Law (UNCITRAL), which deals with the judicial sale of ships.
This convention establishes that a judicial sale carried out in one of its member states that grants the buyer a clean title has the same effect in all other signatory states, providing greater legal security for such transactions.
To facilitate the operation of this regime and safeguard the rights of parties with interests in the ship, a notification and a judicial sale certificate must be issued in the state where the transaction takes place.
APADEMAR members requested PMA’s cooperation in managing the signing of this convention with the Ministry of Foreign Affairs, which will optimize Panama’s Ship Registry.
APADEMAR’s Board Chairman, Joaquín De Obarrio, reaffirmed the association’s commitment to collaborate with PMA in achieving the proposed objectives.
